Position
Head of Litigation, Legal and Compliance
Job Description/Responsibilities:
- Supervision and administrative responsibilities, performance management and disciplinary processes for litigation staff. Manage budget and expenses for litigation affairs. Responsible for internal audit responses on documentation review affairs.
- Lead, manage and develop litigation staff and their tasks with efficient systems and processes for continuity of work and optimal delivery. Maintain litigation tracking system and report regularly to department managers on progress of litigation and tasks.
- Collaborate and work with senior and departmental leadership in identifying, reducing and mitigating potential or actual legal risks in legal enforcement, claims, disputes and litigation.
- Draft, review and give legal opinions on proposals for legal action and existing litigation, compliant with laws and internal policies/procedures, with proactive measures and approaches to reduce legal exposure and legal risks, and optimal recovery and protection of legal interests.
- Supervise, review and assess litigation information in litigation databases, ensuring input of current and updated information. Draft, review and monitor enforcement and defence of intellectual property rights and licences.
- Draft, review, conduct legal research, prepare legal memorandum and give legal opinions on laws, legal claims, legal issues (including employment issues) and internal organisational documents, identifying potential legal risks, assessing the issues impacting legal risk and possible mitigations.
- Liaise with and monitor legal matters and litigation referred to external legal counsel; maintain contracts, ensure payment of legal bills and evaluate performance of external legal counsel for litigation (including employment issues).
- Learn and perform other department jobs, including legal claims and litigation assessments, operation/ maintenance of CaseHub (online litigation database), and compliance related tasks.
- Supervise and maintain circulation by litigation staff of lessons from litigation and judgement, updates on relevant laws, internal organizational documents and legal developments, within the department.
- Learn and perform other department jobs including documentation reviews, potential/existing litigation matters, operation/maintenance of case management database, compliance related tasks etc.
- Visit and make representations, as necessary, field offices, branches, courts, tribunals and other dispute resolution forums, govt. offices, law chambers, enterprises and other places as assigned.
- Communicate among Head Office department staff and with Field Office department staff as necessary, on responsibilities and tasks assigned. Provide reports on a regular basis and as directed or requested, on legal services and tasks assigned. Understand and ensure compliance with organizational policies and procedures. Maintain confidentiality when preparing, sharing and storage of information and documents.
- Ensure the safety of team members from any harm, abuse, neglect, harassment and exploitation to achieve the programme’s goals on safeguarding implementation. Act as a key source of support, guidance and expertise on safeguarding for establishing a safe working environment.
- Practice, promote and endorse the issues of safeguarding policy among team members and ensure the implementation of safeguarding standards in every course of action.
- Follow the safeguarding reporting procedure in case any reportable incident takes place, encourage others to do so.
- Any other task assigned by the supervisor and department from time to time.
Requirements
Educational Requirements:
- LLB (Hons.) from any recognised University with minimum second class in all exams/CGPA 2.5 and above or equivalent and having foreign law degree from England or commonwealth jurisdiction will be given preference.
Experience Requirement:
- Minimum experience of 8 years in Bangladesh court practice in subordinate courts and Supreme Court in commercial law disputes, or in a litigation department of development, financial or business organisations.
Additional Requirements:
- Review of legal documentation.
- Review of internal investigations, potential or completed.
- Administrative tasks within the department.
- Facilitate legal training for department staff.
- Any other task assigned by the Director from time to time.
